 picture:survivalinternational.org In a momentous decision,Botswana’s Court of Appeal today quashed a ruling that denied the Kalahari Bushmen access to water on their ancestral lands. With support from Survival,the Bushmen appealed a 2010 High Court judgment that prevented them from accessing a well which they rely on for water. The panel of five Appeal Court judges has found that: - the Bushmen have the right to use their old borehole,which the government had banned them from using
- the Bushmen have the right to sink new boreholes
- the government’s conduct towards the Bushmen amounted to ‘degrading treatment’.
- the government must pay the Bushmen’s costs in bringing the appeal.
Celebrating after the decision,a Bushman spokesman said,‘We are very happy that our rights have finally been recognized. We have been waiting a long time for this. Like any human beings,we need water to live. We also need our land. We pray that the government will now treat us with the respect we deserve.’ In 2002,the Bushmen were forcibly evicted from their ancestral lands in the Central Kalahari Game Reserve by the Botswana government. They took the government to court and after four years,won a landmark ruling that said they had been evicted illegally and unconstitutionally,and that they have the right to live on their ancestral lands. However,since then,the government has continued to prevent the Bushmen from returning home,by banning them from accessing a well which it capped during the evictions. Despite the lack of water,many Bushmen have returned to their homes,surviving off rainwater and melons,and making arduous journeys by foot or donkey to fetch water from outside the reserve. The Bushmen took the government to court again in a bid to gain access to their well. However. Judge Walia who presided over the 2010 hearing,ruled in favor of the government,arguing that the Bushmen ‘have brought upon themselves any discomfort they may endure’. His ruling has been overturned by unanimous decision of five Appeal Court judges,who ruled that denying Bushmen access to their well amounted to ‘degrading’ treatment,contrary to the Constitution. The government’s treatment of the Bushmen has been widely condemned. The African Commission on Human and Peoples’ Rights slammed the government for denying the Bushmen’s ‘right to life’,while the UN’s top official on indigenous peoples found that the government left the Bushmen to face ‘harsh and dangerous conditions due to a lack of access to water’. Adding to the Bushmen’s misery,the government drilled new wells for wildlife only in the reserve and gave the go ahead for Wilderness Safaris to open a luxury tourist lodge with swimming pool on Bushman land. 30,000 people have now signed a petition calling on Wilderness Safaris to move its lodge off Bushman land. The government has also given the go ahead to Gem Diamonds for a $3bn diamond mine at one of the Bushman communities,and continues to prevent the Bushmen from hunting for food. Survival’s director,Stephen Corry,said today,‘This is a great victory for the Bushmen,and also for Botswana as a whole. We hope it will be embraced as such by the authorities and not be seen as just an obstacle to their attempts to get the Bushmen off their lands for diamond mining. A comment from President Khama would now give the clearest signal of whether or not the government’s position has shifted in the light of the ruling. This is,after all,a victory for human rights and the rule of law throughout Botswana.’ SURVIVAL INTERNATIONAL This is the best news we have heard so far this year! Tshwane community safety spokesperson William Baloyi said four people were rescued in separate incidents when they were swept away in their vehicles as the Hennops River pushed through Centurion. At the same time,emergency personnel were moving through the smallholdings along the river bank to make sure everybody was accounted for,since they first started receiving worried calls after midnight as the river roiled through the farming belt. “Our concentration is on the smallholdings,moving from house to house and checking,”said Baloyi. They were told of a number of people who were unaccounted for,but were hoping they had simply stayed away from home for the night. The rescues were all in the Centurion area. One woman was believed to have been swept away near Nellmapius,so the team was still out searching for her. Netcare 911 spokesperson Jeffrey Wicks said two women were found sitting on top of their cars after being swept away by the Hennops River in Irene,Centurion,late on Sunday night. “The women,separated by several hundred meters,spent hours precariously atop the roofs of their submerged vehicles after the river broke its banks. Both were rescued by medics and firefighters in the early hours of the morning.”
Further south,34 people were evacuated after emergency calls started coming through after midnight from Thembakazi informal settlement,Johannesburg emergency services spokesperson Percy Morokane said. “There were fast moving torrential currents of water. People were under threat of being washed away. “They evacuated people from that settlement as well as from Rabie Ridge and Ebony Park. An operational centre was established at Ivory Park fire station. Click on our product demonstration link to see how our clever systems work. 2010-10-28 20:37 –Cape Town –The quality of bathing water at South African beaches was slowly deteriorating due to poor sewerage management,the Wildlife Society of SA (Wessa) said on Thursday. “We are noticing slow deterioration in bathing water quality along most of the coast and this appears to be related to poor sewerage and storm water management within the broader catchment that leads to the beaches,”said Wessa Blue Flag programme manager Alison Kelly. She said water quality in rivers and estuaries was deteriorating markedly. “The release of the Green Drop report earlier this year highlights the very real challenges this country faces in managing waste water management systems and the need for us to ensure that the necessary skills and technical ability is in place at local government level,”said Kelly. She was speaking at an event in Mossel Bay where Tourism Minister Marthinus van Schalkwyk launched the Blue Flag beaches for 2010/2011. A total of 27 beaches countrywide received Blue Flag status,an international annual award given to beaches that meet excellence in the areas of safety,amenities,cleanliness,environmental information and environmental management. This is according to data compiled by the Council for Scientific and Industrial Research (CSIR),which has developed a forecasting technique that is able to estimate the chances of El Niño or La Niña. The El Niño phenomenon occurs when water around the equator in the Pacific Ocean is warmer than usual. Its twin is La Niña,which is followed by cold weather. “There is almost no chance for an El Niño this summer,”said Dr Willem Landman from the CSIR’s department for climate study and modelling. “To tell the truth,the current La Niña will be present throughout summer.” With the La Niña phenomenon,there is greater chance for a wet season in summer rainfall areas. “The latest forecasting method shows that the season might start slowly but that mid-summer looks very promising for rain.” The United Nations said this week that the current La Niña phenomenon would strengthen over the next four to six months. This is due to the strong interaction between the current oceanic and atmospheric conditions and the large area where below-average ocean temperatures are being experienced,according to the World Meteorological Organisation. 59 minutes ago Reuters –Johannesburg –Eskom said on Monday it expects to become a dominant solar energy player as it seeks to reduce its carbon footprint,with plenty of funding available to pay for renewable ventures. Eskom relies on coal for more than 90% of its power supply,but has vowed to invest in renewable energy and more efficient coal technologies to reduce its absolute carbon dioxide emissions,which totaled 225 million tonnes in its last financial year,from 2025. Steve Lennon,Managing Director for Corporate Services,said that while a 100MW wind farm should come on stream by early 2012 and a 100 MW solar thermal plant should be commissioned by 2015,the state-owned utility was already planning beyond that. “As a minimum we would see very close to 2 000MW in solar thermal by 2030,but with a possibility of a lot more depending on how the business case comes out,”he told Reuters in an interview. Eskom’s solar thermal plans go parallel with a 5 000 MW solar park planned by the government,where the first megawatts are expected to be produced as soon as 2012.
